Terms and Conditions
Introduction
We are Time For African Adventures Ltd (hereinafter referred to as “TFAA” or “we”), a company based in Arusha, Tanzania, duly registered under number 150317665, and owned by Zacharia Sarja Girgis and Rui Miguel Capucho. These Terms and Conditions apply to all itineraries and tours booked with TFAA, governing the contractual relationship between TFAA and its clients. By making a booking with us, the client confirms that they have read, understood and agreed to the terms set forth herein.
1.Booking Agreement
1.1. To initiate the booking process, a ‘Booking Invoice’ will be issued, indicating the initial payment amount, which corresponds to 40% of the total itinerary cost.
1.2. Any additional services added later will be calculated based on the exchange rate in effect at the time of the amendment.
1.3. The client expressly authorizes the sharing of personal information with local partners for booking purposes, as required for the execution of the trip.
1.4. The purchase of international airfare is the sole responsibility of the client.
1.5. The confirmation of the booking and respective accommodations will only be finalized after receipt of the initial deposit amount. Should the proposed accommodations no longer be available at the time of receipt and the commencement of the reservation process by us, TFAA reserves the right to proceed with booking similar or higher-category alternatives. In the event that higher-category accommodations are selected, the client will be duly informed of any additional costs, and the reservation of such alternatives will only proceed after the client’s express confirmation.
2.Payments
2.1. The final balance payment must be made no later than 60 days prior to your arrival.
2.2. For bookings made less than 30 days in advance, full payment is required.
2.3. All bank charges, including transfer fees, are the sole responsibility of the client.
2.4. If the client has specific requirements for invoice issuance, such as the inclusion of additional or personalized tax information, they must notify us at the time of payment. Requests made afterward may not be accommodated or may be subject to limitations.
2.5. Group Invoice Issuance: For group bookings where payment is made via a single bank transfer, the invoice will be issued exclusively in the name of the person or entity responsible for the payment. Individual invoices for group members cannot be issued unless payments are made separately by each participant.
3.Cancelation Policy
If you are forced to cancel your trip, you must notify us in writing or by email. Cancellation fees are based on the date your written/email notification is received by TFAA. To cover our estimated loss caused by your cancellation, the following cancellation fees will be charged per person:
Days Before Your Arrival and Cancellation Fee
- Cancellation Notice 91 days or more: Deposit only
- Cancellation Notice between 90-60 days: 50% of the total value
- Cancellation Notice between 59-30 days: 75% of the total value
- Cancellation Notice between 29-16 days: 90% of the total value
- Cancellation Notice less than 15 days or No-Show: 100% of the total value
3.1. Cancellation Documentation: Documentation proving a valid reason for cancellation, such as medical emergencies or illness, may be required. A medical certificate may also be requested to assist with obtaining refunds, rescheduling, or cancellations.
3.2. Travel and Cancellation Insurance: If the reason for cancellation is covered under the terms of your insurance policy, you may claim the costs directly from your insurer. TFAA can provide an official cancellation document for your claim.
3.3. Safaris Already Started: No refund will be provided for any unused portion of your safari once it has commenced.
3.4. Reservation Transfer: You may transfer your booking to another person who meets all the applicable conditions of the booking. The request must be made in writing or by email at least 45 days before arrival. Both the original client and the new traveler are responsible for any additional costs incurred due to the transfer.
3.5. Postponements: Requests for postponement must be communicated in writing or by email at least 45 days before arrival. Upon request, we will check availability for the new dates at no additional cost, except for postponements to peak seasons (June to October and December to February), where additional charges may apply.
3.6. Refunds: TFAA will make every effort to provide refunds for valid and proven reasons; however, we are subject to the refund policies of accommodations. A credit note may be issued for use by the client at the same or affiliated accommodations for future dates or periods, subject to availability. Any price/rate differences will be borne by the client. Refunds will be made based on the amounts fully paid to TFAA, minus any associated banking fees. If, for any reason, a partial refund is required, it will be issued using the exchange rate at which the trip’s cost was originally based.
3.7. Cancellation by TFAA: Although we have never needed to cancel confirmed bookings, we reserve the right to do so in cases of force majeure or extraordinary and unavoidable situations. TFAA will not be liable for additional costs or losses arising from cancellations due to force majeure.
3.8. Force Majeure: We regret that we cannot provide compensation when the proper performance of our obligations is affected by incidents that neither we nor the service provider(s) could foresee or avoid, even with all due care. Such events may include war, terrorist activity, unexpected government actions, riots, civil conflicts, natural disasters, border closures, industrial disputes, fires, road closures, thefts, epidemics, quarantines, land and air travel disruptions, extreme weather conditions, and other similar incidents beyond our control.
4.Travel Insurance
TFAA does not provide personal travel insurance. Clients are responsible for obtaining adequate insurance that covers cancellations, medical assistance, evacuation, and other travel-related contingencies.
5.Medical Information and Fitness for Tours
Clients are solely responsible for assessing their physical fitness and ability to participate in the tours. We recommend consulting a medical professional to ensure full capability for the booked experience.
Clients should seek medical advice regarding mandatory or recommended vaccinations and any specific precautions related to the trip.
Our itineraries often include visits to remote areas with limited medical infrastructure. While we strive to ensure our clients’ safety, we cannot guarantee the standard or availability of medical facilities or treatments in these locations.
6.General Conditions
6.1. TFAA endeavors to accommodate special requests but does not guarantee their fulfillment.
6.2. Itinerary or accommodation changes may occur due to factors beyond our control, such as unavailability or extraordinary events.
7.Prices, Surcharges and Taxes
Adventure travel in Africa requires flexibility, and clients acknowledge that changes to tours may be necessary. This includes adjustments to routes, schedules, itineraries, accommodations, or modes of transportation due to mechanical issues, strikes, border difficulties, or other unforeseen circumstances.
TFAA is not liable for unused services unless caused by a direct fault of the company, its suppliers, or representatives. In cases of inappropriate behavior by the client, TFAA reserves the right to terminate participation in the tour without refund.
If the reserved accommodation is unavailable, an alternative of equal or higher standard will be provided.
8.Risk
Clients acknowledge the inherent risks of TFAA tours, including visits to remote areas. Clients are responsible for taking safety precautions, following provided guidelines, and adhering to local laws.
TFAA is not liable for losses, damages, injuries, or death resulting from the client’s failure to follow instructions or from events beyond the company’s control.
9.Complaints
Any complaints during the tour must be communicated to TFAA’s management via email at info@timeforafricanadventures.com or by calling +255 765 395 153 / +351 910 512 569. Post-tour complaints must be submitted in writing within 30 days of the experience’s conclusion.
10.Third-Party Suppliers
While TFAA carefully selects suppliers for accommodations, transportation, and other services, it cannot control their actions or omissions. TFAA is not responsible for inconveniences or damages resulting from independent suppliers’ failures.
11.Liability
TFAA is not liable for losses or damages arising from:
- The client’s failure to follow guidelines;
- Actions or omissions of third parties unrelated to the tour;
- Force majeure events.
Clients are responsible for ensuring the safety of their personal belongings throughout the journey.
12.Force Majeure
“Force Majeure” refers to events beyond TFAA’s control, such as natural disasters, wars, strikes, or extreme weather conditions. In the event of force majeure, TFAA reserves the right to modify or cancel bookings. TFAA will make every effort to provide refunds, deducting reasonable costs.
13.Images & Marketing
TFAA reserves the right to use photographs and videos captured during tours for marketing purposes. Consent for such use is implied unless the client explicitly objects.
14.Amendments
TFAA may revise these Terms and Conditions at any time, with updates published on the official website. Changes take effect 10 days after publication. Clients are encouraged to review the updated Terms before their journey.
15.Disclaimer
The information provided on TFAA’s website is for reference only and may change without notice due to supplier or government policy updates. The final interpretation of these Terms rests with TFAA.
16.Final Provisions
By accepting these Terms and Conditions, the client acknowledges the inherent flexibility of travel in Africa, understanding that changes may be necessary to ensure a safe and memorable experience.
